Terms of service
These terms apply when you use Fairola to build a website, take bookings, send invoices or accept payments. By saving a website or signing in, you agree to them. Fairola is operated by CONON TECH PTY LTD (ABN 92 665 618 511), Suite 87, 34 Welshpool Road, Welshpool WA 6106. In these terms, “we” means Fairola and “you” means the business using it.
1. Using Fairola
- You must be 18 or older and use Fairola for a real business.
- Keep your sign-in email secure. You're responsible for what happens in your account.
- Follow our acceptable use policy. It explains what can't go on a Fairola website.
2. Your website and content
- You own the content you give us: text, photos, prices and business details. You give us permission to host, copy and display it so we can run your website.
- You're responsible for making sure your content is accurate and that you have the right to use it, including photos you upload.
- Stock photos we suggest come from Unsplash or Pexels under their licences. They're labelled, and you can replace them with your own at any time.
3. AI-written content
Fairola uses AI to write website copy from the details you give us. It's designed not to invent facts: anything it doesn't know is left blank, and claims are checked against your business details. AI can still make mistakes, so you must review your website before you publish it and keep it accurate. You're responsible for what your published website says.
4. Reviews
Only add reviews that real customers actually wrote, with their permission to show their name. Fake or altered reviews can break the Australian Consumer Law. We may remove reviews we believe aren't genuine.
5. Publishing and verification
Before a free website goes live, we ask you to confirm your business, for example with your ABN, a mobile number or a payments account. We may review, pause or remove a website that looks misleading, unsafe or unlawful, and we'll tell you why.
6. Plans, billing and cancelling
- The Free plan costs nothing. Paid plans are billed monthly or yearly in advance, in Australian dollars, and prices include GST. Current prices are on our pricing page.
- Paid plans renew automatically until you cancel. You can cancel any time from your billing page; you keep paid features until the end of the period you've paid for.
- If a payment fails, we'll retry for a few days and keep your features on. If it still fails, your account moves to the Free plan.
- We'll give you at least 30 days' notice by email before we raise the price of your plan.
- We don't refund part-used billing periods, except where the law requires it.
7. Bookings and online payments
- Bookings, quotes and sales made through your website are between you and your customer. You set your services, prices, deposits and cancellation policy, and you're responsible for honouring them.
- Online payments are processed by Stripe. To accept them you need a Stripe account and must agree to Stripe's terms, including the Stripe Connected Account Agreement. Payouts, disputes and chargebacks are handled under those terms.
- We charge a platform fee on online payments depending on your plan (shown on the pricing page). This is in addition to Stripe's own fees.
- Refunds you give customers come from your Stripe balance.
8. Invoices and tax
Fairola helps you create invoices, quotes, credit notes and GST tax invoices. You're responsible for the details on them, for whether you're registered for GST, and for meeting your own tax obligations.
9. Your customers' information
When your customers book, enquire or pay, you decide how their information is used, and you must handle it lawfully, including under the Privacy Act 1988 where it applies to you and the Spam Act 2003 for marketing emails. We store and process it on your behalf as described in our privacy policy.
10. Availability and changes
We work to keep Fairola running and your data safe, but we can't promise it will never be interrupted. We may change or improve features over time. If we remove something you rely on or change these terms in a way that matters, we'll email you at least 30 days before the change takes effect.
11. Suspending or closing an account
- You can stop using Fairola at any time. Email info@fairola.com to close your account, or ask for a copy of your data first.
- We may suspend or close an account that seriously or repeatedly breaks these terms or our acceptable use policy, or where the law requires it. Where we can, we'll warn you first and give you a chance to fix the problem.
12. Your rights under Australian Consumer Law
Our services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.
13. Liability
To the extent the law allows, we're not liable for indirect or consequential loss, such as lost profits or lost bookings, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. Where the Australian Consumer Law allows us to limit liability for a failure to meet a guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
14. Governing law
These terms are governed by the laws of Western Australia, Australia, and the courts of Western Australia have jurisdiction.
